1. Introduction | المقدمة

1.1 These Terms and Conditions, including their provisions, define the mechanism for using the Masarat Platform. Your use of the platform constitutes full acceptance of these entire Terms and Conditions. If you do not agree with them or any part thereof, you must refrain from using the platform.

 تحدد هذه الشروط والأحكام بما فيها من بنود آلية استخدام منصة مسارات، حيث يُعد استخدامك للمنصة قبولاً تاماً بكامل هذه الشروط والأحكام، فإن لم تكن موافقاً عليها أو على أي جزء منها فيجب عليك الامتناع عن استخدام المنصة

2. The Platform | المنصة

2.1  Masarat Platform is an electronic platform owned by Masarat Al-Terhal Company ("Masarat"). The platform aims to provide domestic and international tour organization services through a variety of diverse packages, delivering the best level of organization and applying the highest safety standards.

منصة مسارات هي منصة إلكترونية تعود ملكيتها لشركة مسارات الترحال " مسارات "، تهدف المنصة إلى تقديم خدمات تنظيم الرحلات السياحية الداخلية والخارجية من خلال العديد من الباقات المتنوعة عبر تقديم أفضل مستوى تنظيم وتطبيق أعلى معايير السلامة

3. Parties to the Platform | أطراف المنصة

3.1 The Company: Refers to Masarat Al-Terhal Company ("Masarat"), which is the owner of the platform.

الشركة: يقصد بها شركة مسارات الترحال "مسارات"، وهي مالكة المنصة 

3.2 The Client: Refers to any natural or legal person in their capacity as the user/service requester/adventurer who has submitted a request for any of the platform's services.

العميل: وهو كل شخص طبيعي أو اعتباري بصفته المستخدم/طالب الخدمة/المغامر الذي تقدم بطلب أحد خدمات المنصة

3.3 The Authorized Representative: Refers to any legal person in their capacity as an authorized proxy by the Client to use the platform

المفوض: هو كل شخص اعتباري بصفته مفوض من قبل العميل لاستخدام المنصة

4. Registration on the Platform | التسجيل في المنصة

4.1 To benefit from Masarat's services, it is mandatory to register on the platform via the electronic link "masaratclub.com".

 "masaratclub.com"يتطلب للاستفادة من خدمات مسارات وجوب التسجيل في المنصة عبر الرابط الالكتروني

4.2 The data required upon registration includes: (Full Triple Name – ID/Residence Number – Date of Birth).

من ضمن البيانات المطلوبة عند التسجيل: (الاسم الثلاثي – رقم الهوية – تاريخ الميلاد)

4.3 After completing the registration process requirements on the platform and attaching the required documents, and once the Client and/or the user obtains the username and password, each of them becomes responsible for maintaining the confidentiality of this data and not sharing it with third parties.

بعد استكمال متطلبات عملية التسجيل في المنصة وإرفاق المستندات المطلوبة، وبمجرد حصول العميل و/أو على أسم المستخدم وكلمة المرور، يصبح كلاً منهم مسؤولين بالمحافظة على سرية هذه البيانات وعدم مشاركتها مع الغير

4.4 It is required that the use of services by the Client/Authorized Representative via the platform be conducted legally and for legitimate purposes only, in accordance with the platform's Terms and Conditions published on the website.

يشترط أن يتم استخدام الخدمات من قبل العميل/المفوض عبر المنصة أن تكون بشكل قانوني ولأغراض مشروعة فقط وفقاً لشروط وأحكام المنصة والمنشورة في الموقع الالكتروني

5.Use of the Platform | استخدام المنصة

5.1 Prior to using any of the services available on the platform, the Client undertakes to review and comply with all the Terms and Conditions published on the Company’s website. These Terms, Conditions, policies, and the platform registration form are considered an integral and complementary part of these Terms and Conditions.

يلتزم العميل قبل استخدام أياً من الخدمات المتاحة في المنصة بالاطلاع والالتزام بكافة الشروط والأحكام المنشورة في موقع الشركة الالكتروني، حيث تعتبر هذه الشروط والأحكام والسياسات ونموذج التسجيل في المنصة جزء لا يتجزأ من هذه الشروط والأحكام ومكمل لها

5.2 The Client undertakes to notify the Company immediately of any unauthorized or unlawful use of the platform by the Authorized Representative or others. This includes, but is not limited to, cases of suspicion and doubt if the account is hacked or used without prior permission or consent.

يلتزم العميل بإخطار الشركة مباشرة عن أي استخدام غير مشروع للمنصة من قبل المفوض أو غيره، ويشمل ذلك على سبيل المثال لا الحصر حالات الشك والريبة في حال اختراق الحساب واستخدامه بدون إذن أو موافقة مسبقة

5.3 The Client undertakes to notify the Company immediately of any changes to the data previously submitted during the registration request on the platform. The Company shall bear no liability for any damages resulting from the Client’s delay in reporting such change, or for any unauthorized transactions arising from the failure to notify.

يلتزم العميل بإبلاغ الشركة فوراً عند إجراء أي تغيير بالبيانات التي سبق تقديمها عند طلب التسجيل بالمنصة، حيث لا تتحمل الشركة أي أضرار ناتجة عن تأخر العميل بالإبلاغ عن ذلك التغيير أو أية عمليات غير مشروعة لعدم الإبلاغ

5.4 The Client acknowledges and agrees to the Company's right, whenever necessary, to delete, suspend, halt, modify, reject registration, or deactivate any request on the platform without any liability on the part of the Company, provided that this does not affect any existing paid-up requests.

يلتزم العميل بأحقية الشركة متى ما أقتضى الأمر حذف أو تعليق أو إيقاف أو تعديل أو عدم تسجيل أو عدم تفعيل أي طلب في المنصة دون أدنى مسؤولية على عاتق الشركة، على أن لا يؤثر ذلك على أي طلبات قائمة مدفوعة الرسوم

5.5 The Client acknowledges that requesting any of the services via the platform does not imply acceptance, undertaking, or commitment by the Company to provide the service.

يلتزم العميل بأن طلب أياً من الخدمات عبر المنصة لا يعني قبول أو تعهد أو التزام الشركة بتقديم الخدمة

5.6 The Client acknowledges that any links, references, or advertisements to other hyperlinks or websites do not mean or represent any type of endorsement or approval by the Company of their content, and the Company shall not be responsible for the opinions, ideas, viewpoints, statements, and information displayed therein

يلتزم العميل بأن أي روابط أو إشارات أو إعلانات لأي روابط أو مواقع أنترنت أخرى لا تعني ولا تمثل أي نوع من مصادقة أو تأييد الشركة على محتوياتها ولا تكون بشأن ذلك مسؤولة عن الأراء والأفكار ووجهات النظر والتصريحات والمعلومات التي تعرض بها

6. Trips | Programs Policy:

6.1 The Client undertakes to adhere to the conduct and public morals that reflect society’s values, principles, and identity, including the prevailing customs, traditions, and culture, in accordance with the relevant rules and laws of each country.

يلتزم العميل بالسلوك والآداب التي تعبر عن قيم المجتمع ومبادئه وهويته بما في ذلك العادات والتقاليد والثقافة السائدة وفق الأنظمة والقوانين ذات الصلة في كل دولة

6.2 When appearing in a public place, the Client undertakes to dress modestly in clothing that does not carry immoral images or phrases, political symbols, or anything that violates public decency.

يلتزم العميل عند الظهور في مكان عام بارتداء زي أو لباس محتشم دون أن تحتمل على صور أو عبارات غير أخلاقية أو رموز سياسة، وكل ما من شأنه يسيء الى الذوق العام

6.3 The Client acknowledges that they are fully aware of all types of risks associated with the trips regardless of their type or severity, and the Client alone assumes all resulting liabilities. The Client hereby waives and releases the Company, its employees, and its contractors from any financial or moral claims arising therefrom.

يقر العميل أنه مدرك تماماً كافة أنواع المخاطر المصاحبة للرحلات مهما كان نوعها او خطورتها، ويتحمل العميل هو وحده كافة المسؤوليات المترتبة، كما يعفي الشركة ومنسوبيها والمتعاقدين معها من أي مطالبات مادية أو أدبية نتيجة لذلك

6.4 The Client acknowledges that they possess the necessary physical fitness required prior to registering for any program, according to the specific circumstances of each trip. Therefore, the Client must disclose to the Company any medical, pathological, psychological conditions, or any other circumstances that might impede the course of any trip. The Company reserves the right to exclude the Client without refunding any amounts, and the Client shall bear any other fees resulting therefrom.

يقر العميل بأنه يتمتع باللياقة البدنية اللازمة قبل التسجيل في أي برنامج حسب ظروف كل رحلة على حدة، لذا يتوجب على العميل الإفصاح للشركة عن أي حالات صحية أو مرضية أو نفسية أو أي ظروف أخرى قد تعيق مسار أي رحلة، حيث تحتفظ الشركة بحقها في استبعاد العميل دون استرجاع أي مبالغ كما يتحمل العميل أي رسوم أخرى نتيجة لذلك

6.5 The Client acknowledges the obligation to fully comply with the directives of the trip leader or whoever acts on their behalf during the trip. These directives are considered binding and final. In the event of total or partial non-compliance with these directives, the Company/trip leader or whoever acts on their behalf reserves the right to exclude the Client and leave the site without refunding any amounts, and the Client shall bear any other fees resulting therefrom.

يقر العميل أثناء الرحلة بالالتزام الكامل لتوجيهات القائد أو من ينوب عنه أثناء الرحلة، حيث تعتبر هذه التوجيهات ملزمة ونهائية، وفي حال عدم تنفيذ هذه التوجيهات كلياً أو جزئياً فأنه يحق للشركة/قائد الرحلة أو من ينوب عنه استبعاد العميل ومغادرة الموقع دون استرجاع أي مبالغ كما يحتمل العميل أي رسوم أخرى نتيجة لذلك

6.6 The Client undertakes to provide and wear the required equipment and gear specified for the trip. The Company is not responsible for providing them to clients, and the Company disclaims all legal liability for any consequences arising from the failure to provide or wear them.

يلتزم العميل بتوفير وارتداء المعدات والملابس المطلوبة الخاصة بالرحلة، حيث ان الشركة ليست مسؤولة عن توفيرها للعملاء، كما تخلي الشركة مسؤوليتها القانونية عما قد يترتب عن عدم توفيرها أو ارتدائها

7. Restriction of Access | تقييد الوصول

7.1 The Company may restrict the Client's access to some or all services on the platform at its absolute discretion. The Client undertakes to refrain from using the platform in any manner that causes or may cause damage, or impairs the availability or accessibility of the platform, or its use in any unlawful, illegal, fraudulent, or harmful way, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity. Furthermore, the Client shall refrain from copying, storing, hosting, transmitting, sending, using, publishing, or distributing any materials containing or linked to any Spyware, Computer Virus, Trojan Horse, Worm, Keystroke Logger, rootkit, or any other malicious or harmful software.

 يجوز للشركة تقييد وصول العميل إلى بعض أو كل الخدمات في المنصة وفق تقديرها المطلق، كما يلتزم العميل بالامتناع عن استخدام المنصة بأي طريقة تتسبب أو قد تتسبب بإلحاق ضرر أو بإضعاف إتاحة أو إمكانية دخول المنصة أو استخدامها بأي طريقة غير مشروعة أو غير قانونية أو احتيالية أو ضارة أو تتعلق بأي غرض أو نشاط غير مشروع أو غير قانوني أو احتيالي أو ضار، بالإضافة إلى الامتناع عن استنساخ أو تخزين أو استضافة أو نقل أو إرسال أو استخدام أو نشر أو توزيع أي مواد تحتوي على أو ترتبط بأي برنامج تجسس Spyware أو فيروس كمبيوتر Computer Virus أو حصان طروادة Trojan Horse أو دودة الانترنت Worm أو عبر مسجل المفتاح Keystroke Logger أو تقنية التحكم الخفي في الكمبيوتر rootkit أو أي برامج خبيثة أو ضارة

8. Fees | الرسوم

8.1 To use the services on the platform, the Client undertakes to pay the prescribed fees for each service to the Company. These fees do not include, but are not limited to, Value Added Tax (VAT) and any other fees that may be imposed by the competent authorities.

يلتزم العميل في سبيل استخدام الخدمات في المنصة على دفع الرسوم المقررة لها مقابل كل خدمة لصالح الشركة، على أن هذه الرسوم لا تشمل ضريبة القيمة المضافة على سبيل المثال لا الحصر وغيرها من الرسوم التي قد يتم فرضها من قبل الجهات المختصة.

8.2 The Company reserves the right to modify or add any fees for any of the services, whether for existing services, properties, or features, or new ones in the future. Such modifications and additions shall be deemed effective and binding.

يحق للشركة تعديل أو إضافة أي رسوم أياً من الخدمات سواء كانت لخدمات أو خصائص أو مميزات موجودة أو جديدة في المستقبل، وتعتبر هذه التعديلات والإضافات نافذة وملزمة

8.3 The Client acknowledges that the trip fees do not include photography/videography services or other related services.

يقر العميل بأن رسوم الرحلة لا تشمل خدمة التصوير الفوتوغرافي / مقاطع الفيديو وغيرها من الخدمات ذات الصلة

9. Ownership of the Platform | ملكية المنصة

9.1 All intellectual property rights related to the platform, including programming codes, matrices, equations, ciphers, designs, photographs, videos, databases, user interfaces, control panels, icons, trademarks, and templates are the exclusive property of the Company. The Company alone possesses the right to use and exploit them at its absolute discretion. The Client has no right to share or transmit any materials, images, or data in any form from the platform without obtaining prior written consent from the Company.

كافة حقوق الملكية الفكرية المتعلقة بالمنصة بما في ذلك أكواد البرمجة، والمصفوفات، والمعادلات، والشيفرات، والتصاميم والصور الفوتوغرافية ومقاطع الفيديو وقواعد البيانات وواجهات المستخدم، ولوحات التحكم والرموز والعلامات التجارية والقوالب تعد ملكاً خاصاً بالشركة، ويكون لها منفردة حق استخدامها واستثمارها وفقاً لتقديرها المطلق، ولا يحق للعميل مشاركة أو إرسال أي مواد أو صور أو بيانات بأي شكل من الأشكال من المنصة دون الحصول على موافقة خطية من الشركة

9.2 The Company is deemed the sole owner of the platform with all its elements and contents, enjoying all rights related to ownership, and solely assumes all liabilities arising from this capacity. The Client, their representative, or their Authorized Representative has no right to use the platform or any part thereof for purposes other than those designated for it.

تعتبر الشركة هي المالك الوحيد للمنصة بكافة عناصرها ومحتوياتها، وتتمتع بكافة الحقوق المتعلقة بحق الملكية كما تتحمل منفردة كافة المسؤوليات المترتبة عن هذه الصفة؛ ولا يحق للعميل أو من يمثله أو مفوضه باستخدام المنصة أو أي جزء منها لغير الأغراض المخصصة لها

10. Privacy Policy | سياسة الخصوصية

10.1 Without prejudice to the Client's rights regarding their intellectual property and their right to protect their privacy, all data entered into the platform, including names, addresses, personal and official details, are considered the exclusive property of the Company. The Company maintains the information collected before, during, or after providing the services in strict confidentiality. Nevertheless, this information may be provided whenever there is an official request from a regulatory or supervisory authority, or pursuant to a judicial ruling. The Company may build databases for various purposes, issue reports and statistics, and utilize them in the manner it deems fit, including using them for marketing and promotional purposes.

دون الاخلال بحقوق العميل المتعلقة بملكياتهم الفكرية وحقهم في حماية خصوصيتهم، تكون كافة البيانات التي يتم إدخالها في المنصة من أسماء وعناوين وبيانات شخصية ورسمية تعد ملكاً خاصاً بالشركة وتحتفظ بالمعلومات التي تقوم بجمعها قبل أو أثناء أو بعد تقديم الخدمات بسرية تامة، وبالرغم من ذلك يجوز تقديم هذه المعلومات متى ما كان هناك طلب رسمي من جهة تنظيمية أو رقابية أو بناء على حكم قضائي، ويجوز للشركة بناء قواعد بيانات ذات أغراض مختلفة وإصدار تقارير وإحصاءات وتستغلها بالشكل الذي تراه، بما في ذلك استخدامها لأغراض تسويقية وترويجية

10.2 Without prejudice to the Client's rights, including but not limited to photographing landscapes and museums, they are not entitled to photograph others or publish such photos without obtaining written or electronic consent from the Company. In all cases, the Company disclaims its liability towards any lawsuit or liability resulting therefrom in the event of violating any related laws, while the Company retains its statutory rights to seek recourse against the causing party.

دون الاخلال بحقوق العميل على سبيل المثال لا الحصر في تصوير المناظر الطبيعية والمتاحف، فإنه لا يحق له تصوير الغير أو نشرها دون الحصول على موافقة خطية أو إلكترونية من قبل الشركة، وفي كل الأحوال تخلي الشركة مسؤوليتها تجاه أي دعوى أو مسؤولية تترتب عليها في حال انتهاك أي من القوانين ذات العلاقة مع احتفاظ الشركة بحقوقها النظامية بالرجوع على المتسبب

10.3 The Company reserves the right to use photographs/videos captured of the Client during the trip in the manner and method the Company deems appropriate, or for advertising, marketing, or any other commercial purpose, and to publish them across the Company’s accounts on the website and social media platforms. These materials captured by the Company/trip leader or any of its employees shall belong to the Company, unless the Company/leader is notified prior to the start of the trip of the desire not to take, retain, or publish photographs/videos.

يحق للشركة استخدام الصور الفوتوغرافية / مقاطع الفيديو التي يتم التقاطها للعميل اثناء الرحلة بالشكل والطريقة التي تراها الشركة مناسبة أو لغرض الإعلان والتسويق ولأي غرض تجاري أخر ونشرها عبر حسابات الشركة في الموقع الالكتروني وحسابات التواصل الاجتماعي، وتكون هذه المواد التي تم التقاطها بواسطة الشركة/قائد الرحلة او أحد منسوبيها تعود ملكيتها للشركة، مالم يتم اخطار الشركة/القائد بعدم الرغبة بالتقاط الصور الفوتوغرافية / مقاطع الفيديو او بالاحتفاظ بها او نشرها قبل بدأ الرحلة

11. Limitation of Liability | حدود المسؤولية

11.1 The Company will exert the necessary effort and due diligence to manage technical risks that may affect the workflow and performance of operations related to the platform, and assumes liability for errors resulting from the negligence, omission, or infringement of its employees. However, at the same time, it disclaims liability for any interruption or unavailability of the services/platform due to circumstances beyond the Company's control, resulting from network connection failure or due to Force Majeure and its resulting natural disasters, wars, or regulatory or supervisory restrictions, including but not limited to. In all cases, the Company's liability shall not exceed (10%) of the value of the damage proven by a conclusive and final judicial ruling.

ستقوم الشركة على بذل الجهد والعناية اللازمين لإدارة المخاطر التقنية التي قد تؤثر على سير وأداء العمليات المتعلقة في المنصة، كما تتحمل المسؤولية عن الأخطاء التي تنتج عن تقصير أو إهمال أو تعدي موظفيها. إلا أنها في ذات الوقت تخلي مسؤوليتها عن أية انقطاع أو عدم توفر الخدمات/المنصة بسبب ظروف خارجة عن إرادة الشركة نتيجة فشل في الاتصال بالشبكة أو بسبب القوة القاهرة وما ينتج عنها من كوارث طبيعية أو حروب أو قيود تنظيمية أو رقابية على سبيل المثال لا الحصر، وفي كل الأحوال لن تتعدى مسؤولية الشركة بما نسبته (10%) من قيمة الضرر المثبت بحكم قضائي قطعي ونهائي

11.2 Services are provided on an "as is" and "as available" basis on the platform. The Company disclaims all warranties of any kind, whether express or implied, and assumes no liability for any direct or indirect loss or damage, to the maximum extent permitted under rules and laws, in the event of any malfunction of any kind in the services/platform or failure to access them as required.

ستقوم الشركة على بذل الجهد والعناية اللازمين لإدارة المخاطر التقنية التي قد تؤثر على سير وأداء العمليات المتعلقة في المنصة، كما تتحمل المسؤولية عن الأخطاء التي تنتج عن تقصير أو إهمال أو تعدي موظفيها. إلا أنها في ذات الوقت تخلي مسؤوليتها عن أية انقطاع أو عدم توفر الخدمات/المنصة بسبب ظروف خارجة عن إرادة الشركة نتيجة فشل في الاتصال بالشبكة أو بسبب القوة القاهرة وما ينتج عنها من كوارث طبيعية أو حروب أو قيود تنظيمية أو رقابية على سبيل المثال لا الحصر، وفي كل الأحوال لن تتعدى مسؤولية الشركة بما نسبته (10%) من قيمة الضرر المثبت بحكم قضائي قطعي ونهائي

11.3 The Client acknowledges that the Company disclaims its liability, partially or totally, for any delay, cancellation, modification, or default in providing any of the programs, trips, or related services, whether by the Company or by a third party, due to force majeure, emergency circumstances, bad weather conditions, or what is decreed by the competent authorities.

يقر العميل بأن الشركة تخلي مسؤوليتها جزئياً أو كلياً عن أي تأخير أو إلغاء أو تغيير أو التقصير في تقديم أياً من البرامج أو الرحلات أو الخدمات المتعلقة فيها أو من قبل طرف ثالث لظروف قهرية أو طارئة أو بسبب سوء الأحوال الجوية وما يتم إقراره من قبل الجهات المختصة

11.4 The Client acknowledges that the Company disclaims its liability, partially or totally, for all risks associated with the trips in which the Client participates, whether inside or outside the territories of the Kingdom of Saudi Arabia, whether political, social, or economic risks.

يقر العميل بأن الشركة تخلي مسؤوليتها جزئياً أو كلياً عن كافة المخاطر المصاحبة للرحلات التي يشترك فيها العميل سواء كانت داخل أو خارج أراضي المملكة العربية السعودية، سواء كانت مخاطر سياسية أو اجتماعية أو اقتصادية

11.5 The Client acknowledges that the Company disclaims its liability, partially or totally, for any delay, cancellation, modification, or default related to the Client’s bookings with third parties, including but not limited to (Airlines). The Client shall have no right to seek recourse against the Company to demand a refund of the trip fees in the event that they are unable to attend.

يقر العميل بأن الشركة تخلي مسؤوليتها جزئياً او كلياً عن أي تأخير او إلغاء او تغيير او تقصير متعلقة بحجوزات العميل مع الغير على سبيل المثال لا الحصر (شركات الطيران)، ولا يحق للعميل الرجوع على الشركة بطلب استرجاع رسوم الرحلة في حال عدم تمكنه

12. General Provisions | أحكام عامة

12.1 The Client acknowledges that they have no right to assign, delegate, or transfer any of the programs, trips, or tourism services to any other party without obtaining prior written or electronic consent from the Company.

يقر العميل بأنه لا يحق له التنازل أو التفويض أو التحويل لأي من البرامج أو الرحلات أو الخدمات السياحية لأي طرف آخر دون الحصول على موافقة خطية أو إلكترونية من الشركة

12.2 The Client acknowledges that in the event of violating any clause, condition, or provision contained in these Terms and Conditions, or if the Company becomes aware of any misconduct or bad behavior regardless of its nature, the Company reserves the right in this case to block them from using any services provided through the platform or from participating in future trips, without any compensation.

يقر العميل بأنه في حال مخالفة لأي بند أو شرط أو حكم وارد في هذه الشروط والأحكام أو نمى إلى علم الشركة سوء سلوك أو تصرف بغض النظر عن طبيعته، فإن الشركة يحق لها في هذه الحالة منعه من استخدام أياً الخدمات التي تقدمها من خلال المنصة دون تعويض أو المشاركة في الرحلات القادمة

12.3 The Client acknowledges that all information and documents submitted to the Company or uploaded via the platform are correct and non-misleading, and they alone bear full responsibility before the competent authorities in case of violation.

يقر العميل بأن كافة المعلومات والمستندات التي تقدم بها إلى الشركة أو قام برفعها عبر المنصة هي معلومات صحيحة وغير مضللة، ويتحمل وحده المسؤولية الكاملة في حال مخالفة ذلك أمام الجهات المختصة

12.4 The Client acknowledges their review of and compliance with the Anti-Money Laundering and Counter-Terrorism Financing laws and regulations applicable in the Kingdom, and commits to what is stated therein.

يقر العميل باطلاعه والتزامه بأنظمة وقوانين مكافحة غسل الأموال ومكافحة الإرهاب والمعمول به في المملكة والتزامه بما ورد فيها

13. Amendments | التعديلات

13.1 The Client acknowledges that the Company reserves the right to amend any of the services, Terms and Conditions, or the platform's usage policy at any time. Such amendments shall become effective and binding immediately upon being published on the platform. In all cases, the Client’s continued use of the platform after the publication of amendments constitutes acceptance of their content.

يلتزم العميل بأن الشركة يحق لها إجراء التعديل على أياً من الخدمات أو الشروط والأحكام أو سياسة استخدام المنصة في أي وقت، حيث ستكون هذه التعديلات نافذة فور نشرها في المنصة وملزمة، وفي كل الأحوال إن استمرار العميل باستخدام المنصة بعد نشر التعديلات تعتبر موافقة منه على مضمونها

14. Governing Law | القانون واجب التطبيق

14.1 These Terms and Conditions shall be governed by and construed in accordance with the applicable laws and regulations of the Kingdom of Saudi Arabia. In the event of any dispute arising over the interpretation or application of its provisions, it shall be resolved amicably; if amicable settlement fails, it shall be referred to the competent judicial authority in the city of Riyadh.

تخضع هذه الشروط والأحكام للأنظمة واللوائح واجبة التطبيق بالمملكة العربية السعودية، وفي حال نشوء أي نزاع حول تفسير أو تطبيق بنودها فإنه يتم حله ودياً وفي حال فشل الحل فإنه يحال للجهة القضائية المختصة بمدينة الرياض

15. Cancellation, Refund, and Amendment Policy | سياسة الإلغاء والاسترجاع والتعديل

15.1 The Client or their Authorized Representative acknowledges and fully agrees that all or some bookings and services may be non-refundable (fully or partially) or non-amendable immediately upon confirmation and issuance, in alignment with the policies and conditions imposed by suppliers and service providers, which include, but are not limited to:

يقر العميل أو من يفوضه، بعلمه وموافقته التامة على أن كل أو بعض الحجوزات والخدمات قد تكون غير مستردة القيمة كلياً أو جزئياً، أو غير قابلة للتعديل فور تأكيدها وإصدارها، وذلك تماشياً مع السياسات والشروط المفروضة من الموردين ومزودي الخدمة، والتي تشمل على سبيل المثال لا الحصر

Air Transportation: Civil, commercial, and private airlines, and ground services associated with them. النقل الجوي: شركات الطيران المدني، التجاري، والخاص، والخدمات الأرضية المرتبطة بها

Accommodation: Hotels, resorts, camps, and residential and rural inns. الإقامة: الفنادق، المنتجعات، المخيمات، والنزل السكنية والريفية

Logistics Services: Tourist entry visas, and vehicle and car rental services of all kinds. الخدمات اللوجستية: تأشيرات الدخول السياحية، وخدمات استئجار المركبات والسيارات بمختلف أنواعها

Activities and Events: Tour experience operators, organizers, group escorts, and tour guides. الأنشطة والفعاليات: مشغلو التجارب السياحية، المنظمون، مرافقي المجموعات، والمرشدون السياحيون

Hospitality: Restaurants and providers of food and beverage services of all kinds. الضيافة: المطاعم ومقدمي خدمات المأكولات والمشروبات بكافة أنواعها

These strict policies apply to the amounts paid regardless of the timing of submitting the cancellation or amendment request by the Client.

وتطبق هذه السياسات الصارمة على المبالغ المدفوعة بغض النظر عن توقيت تقديم طلب الإلغاء أو التعديل من قِبل العميل

15.2 Rest assured that we at Masarat always place our clients' satisfaction at the forefront; therefore, we work tirelessly on continuous negotiation with our partners among suppliers and service providers to secure the best possible flexible cancellation and amendment policies. In the event of any emergency circumstance, we will review and follow up on each case independently, negotiate with service providers on your behalf, and extend all necessary support to reach the best satisfactory solution for all parties.

 كن على يقين بأننا في مسارات نضع رضا عملائنا في المقدمة دائماً؛ لذا نعمل جاهدين على التفاوض المستمر مع شركائنا من الموردين ومزودي الخدمات لضمان أفضل سياسات إلغاء وتعديل مرنة ممكنة. وفي حال حدوث أي ظرف طارئ، سنقوم بدراسة ومتابعة كل حالة بشكل مستقل والتفاوض مع مزودي الخدمة نيابة عنكم، وتقديم كافة سبل الدعم الممكنة للوصول إلى أفضل حل مرضي لجميع الأطراف

15.3 The Company reserves the right to cancel scheduled trips/programs or terminate the participation of any client therein immediately without giving reasons in accordance with the policy mentioned above, or due to the non-fulfillment of the minimum number of participants required for the scheduled trip/program, and the client will be notified if canceled. In the event of cancellation, the Company’s liability is strictly limited to refunding the paid amount to the Client’s account within 20 working days without any compensation, and the Company disclaims its liability for any expenses incurred by the Client as a result.

تحتفظ الشركة بحقها في إلغاء الرحلات / البرامج المجدولة أو مشاركة أي عميل فيها فوريا دون إبداء أسباب وفقا للسياسة المذكورة أعلاه، او عدم اكتمال الحد الادنى للرحلة المجدولة / البرنامج المجدول، وسيتم اخطار العميل في حال تم إلغاؤها. وتقتصر مسؤولية الشركة في حالة الالغاء بإعادة المبلغ المدفوع لحساب العميل خلال 20 يوم عمل دون أي تعويض، كما تخلي الشركة مسؤوليتها عن أي مبالغ دفعها العميل جراء ذلك
